While the world was busy making plans to spend 11.12.13 in a special manner, the fate of the homosexuals of India was being decided behind the closed doors of the Supreme Court. On this day the Supreme Court chose to throw out a 2009 ruling by the Delhi High Court that had decriminalized gay sex. It was more than expected that the decision will receive some stern reactions from Lesbian, Gay, Bisexual and Transgender community.
I am a proud citizen of India, the largest democracy in the world. But I am extremely, extremely disappointed at the Supreme Court verdict. I felt really sad about the way the highest court in the country has quashed a progressive decision of the lower court. What I feel is even more disappointing is that we are still holding on to the British colonial law, even when homosexual nature between two consenting adults was decriminalized in Britain in a landmark judgement 1967.
Here in India there was never any law dubbing homosexuality a punishable offense before section 377 of the Indian Penal Code came into existence, banning 'carnal intercourse against the order of nature'. Has the Supreme Court forgotten that we have our origins in the land of Kamasutra and sexuality in whatever form it comes is celebrated here.Then why should gay sex between two consenting individuals bother anyone?
I feel this is a black spot on the democracy and human rights of every homosexual individual in India.
I believe that it is a very regressive and oppressive decision. By accepting such a decision we are denying dignity and a respectful life to the member of this community. This will tag and push the gay people in the corner. For now I am numb and speechless!!
So now the honorable Supreme Court will decide who one should fall in love with? The judgement will only instigate more suicides. The law would not understand but this is the fact of life that once you outlaw love, it hurts immensely. We all thought that 11.12.13 will be a day to remember, but now the LGBT community will remember it as a black day.
My question is, "How cruel can you be to criminalize ones sexual orientation? It boggles my heart and mind as to what prompted this judgement."
We are the worlds largest democracy, we offer asylum to refugees from other countries, we are seen as a strong and supremely tolerant country. Yet we have the highest Court of Law in our land delivering such a regressive judgement. The decision has turned the tables for now. But, there might be a revolution and the LGBT community will fight back.
A food for thought experiment - had the Supreme Court delivered a progressive decision, I believe that at least 18 former colonies of Britain, who still follow the archaic law would have taken the cue from us and followed it. But, We Blew the Chance!
I have not an activist who participates actively but even I have a heart and I believe that it's frightening how someone else gets to choose how, when and who you should fall in love with. Doesn't the freedom of choice exist anymore? The Supreme Court should really forgive me for saying that Section 377 of the Indian Penal code doesn't seem like a justice upheld.

My point of writing this to call for people to understand how the Supreme Court has not even allowed individuals to choose who they should fall in love with.
